A grieving family has filed suit against a boater after a boating accident that killed their son. The family of Tony Borcia, 10, described in their suit a nightmare accident in which a speeding boat driven by an intoxicated man ran over their son while he was tubing. David Hatyina, 51, of Bartlett, has been charged with piloting a boat while under the influence of alcohol and cocaine, at an unsafe speed, without a lookout, and failing to yield the right of way. Hatyina was at the wheel of his 29-foot Baja Outlaw, named "Purple Haze," at the time of the accident. His girlfriend Renee Melbourn, 49, was named in the suit for providing Hatyina with drugs and for not stopping him from operating the boat. No criminal charges have been filed against her.
